Welcome to The Graves Collective. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from The Graves Collective LLC (“The Graves Collective,” “we,” “us,” or “our”).

By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms.

1. Our Products

The Graves Collective creates and sells handmade physical products, including custom and personalized items.

Because many of our products are handmade from natural materials such as wood, each item is unique. Natural variations in wood grain, color, knots, mineral streaks, texture, and other characteristics are normal and are not considered defects.

Product photographs are intended to provide an accurate representation of our products; however, the appearance of colors, wood tones, grain patterns, and finishes may vary depending on the material used, lighting, photography, and your device or display.

2. Custom and Personalized Orders

Many of our products are made specifically for each customer and may include names, dates, logos, team names, business names, colors, designs, or other customer-requested elements.

You are responsible for reviewing all personalization information before submitting your order, including spelling, names, dates, numbers, colors, and other requested details.

We will produce personalized items using the information provided with your order. The Graves Collective is not responsible for errors resulting from incorrect information submitted by the customer.

If you discover an error after placing your order, please contact us as soon as possible. We will make reasonable efforts to accommodate changes, but changes cannot be guaranteed once production has begun.

Because custom and personalized products are made specifically for you, they generally cannot be returned, exchanged, or canceled once production has begun unless the product arrives damaged, defective, or materially different from what was ordered.

3. Design Proofs and Approvals

For products where a design proof is provided, you are responsible for reviewing the proof carefully before approving it.

Approval of a proof constitutes acceptance of the spelling, layout, wording, design, and other elements shown in the proof.

Once a proof has been approved and production has begun, additional changes may require an additional charge or may not be possible.

Minor differences between a digital proof and the finished physical product may occur due to the characteristics of natural materials, manufacturing processes, engraving, carving, painting, finishing, and display differences.

4. Customer-Supplied Designs, Logos, and Content

If you provide us with a name, logo, graphic, photograph, design, trademark, team name, or other material for use on a custom product, you represent that you have the right or permission to use and reproduce that material for the requested purpose.

You agree not to submit material that infringes another person's or organization's copyright, trademark, intellectual property, or other legal rights.

The Graves Collective reserves the right to refuse any custom order that we believe may violate applicable law, intellectual property rights, or our business policies.

5. Orders and Payment

All prices are shown in U.S. dollars unless otherwise stated.

Payment is due at the time specified during checkout. An order is not considered accepted until payment has been successfully processed and the order has been accepted by The Graves Collective.

We reserve the right to refuse or cancel an order due to pricing errors, product availability, suspected fraud, inability to complete a requested customization, or other reasonable business circumstances.

If we cancel an order after payment has been collected, we will refund the applicable amount paid for the canceled order.

6. Pricing

We may change product prices at any time without prior notice.

Custom requests, special materials, premium wood species, unusual sizes, complex designs, expedited production, or other modifications may result in additional charges.

Any additional charges for a custom order will be communicated before the additional work is performed whenever reasonably possible.

7. Production Times

Many of our products are made to order. Production times displayed on our website are estimates and are not guaranteed completion or delivery dates.

Production may occasionally take longer due to order volume, material availability, equipment issues, custom design requirements, holidays, or other circumstances.

If you need an item by a specific date, please contact us before ordering so we can determine whether the requested timeline is reasonably achievable.

8. Shipping and Delivery

Shipping and delivery dates are estimates unless expressly stated otherwise.

Once an order has been transferred to a shipping carrier, delays caused by the carrier, weather, transportation disruptions, incorrect addresses, or other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate shipping address.

Additional shipping charges resulting from an incorrect or incomplete address may be the customer's responsibility.

9. Damaged or Incorrect Orders

Please inspect your order promptly after delivery.

If your item arrives damaged, defective, or materially different from what you ordered, please contact us promptly and provide photographs of the product and packaging when applicable.

Depending on the circumstances, we may repair the item, replace it, provide replacement components, or issue a refund or other appropriate remedy.

Normal characteristics of natural wood and handmade products—including variations in grain, color, knots, texture, and minor differences from photographs—are not considered defects.

10. Returns, Exchanges, and Cancellations

Returns, exchanges, refunds, and cancellations are also governed by our Return Policy.

Because personalized and custom products are created specifically for the customer, they are generally not eligible for return or exchange unless they arrive damaged, defective, or materially different from the approved or ordered design.

If there is a conflict between these Terms and a more specific return, refund, shipping, or product policy displayed on our website, the more specific policy will apply to that issue.

11. Product Care and Use

Customers are responsible for following any care instructions provided with a product or included in its product description.

Wood is a natural material that can react to moisture, temperature, sunlight, humidity, and environmental conditions.

Unless a product is specifically described as suitable for a particular environment or use, customers should use reasonable care when exposing products to moisture, direct sunlight, extreme temperatures, or outdoor conditions.

The Graves Collective is not responsible for damage resulting from misuse, improper care, improper installation, modification, neglect, or use inconsistent with the product's intended purpose.

12. Food-Contact Products

Some products may be intended for serving or displaying food.

Customers should follow the care and use instructions provided for these products. Unless specifically described otherwise, wooden serving products should not be placed in a dishwasher, soaked in water, or exposed to prolonged moisture.

Any product represented as suitable for food contact should only be used in accordance with the product description and provided care instructions.

13. Intellectual Property

Unless otherwise stated, the content of our website—including photographs, original product designs, graphics, text, branding, logos, and other original materials—is owned by or licensed to The Graves Collective LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, sell, copy, modify, or commercially use our original website content, photographs, or designs without our permission, except as permitted by law.

14. Website Use

You agree not to use our website for unlawful, fraudulent, abusive, or unauthorized purposes.

You may not attempt to interfere with the operation or security of our website, access systems or information without authorization, introduce malicious code, or use automated methods to improperly collect information from the website.

15. Third-Party Services

Our website may use or link to third-party services, including payment processors, shipping carriers, social media platforms, and e-commerce services.

We are not responsible for the availability, policies, content, security, or actions of third-party services that we do not control.

Your use of those services may also be subject to their own terms and policies.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, products and website services are provided on an “as is” and “as available” basis except for any warranties or rights that cannot legally be excluded.

We do not guarantee that our website will always be available, uninterrupted, secure, or error-free.

Nothing in these Terms is intended to waive or limit any consumer rights that cannot legally be waived under applicable law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, The Graves Collective LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or products.

To the fullest extent permitted by applicable law, our total liability arising from a product purchase will not exceed the amount paid to The Graves Collective for the product giving rise to the claim.

These limitations do not apply where prohibited by law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Graves Collective LLC from claims, damages, liabilities, or expenses arising from materials you provide for customization when those materials infringe or violate the rights of another party.

This includes customer-supplied logos, artwork, photographs, trademarks, names, or other protected materials.

19. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any dispute arising from these Terms or a purchase from The Graves Collective will be handled in accordance with applicable Georgia and federal law.

20. Changes to These Terms

We may update these Terms periodically to reflect changes to our business, products, website, or legal requirements.

The updated Terms will be posted on this page with a revised “Last Updated” date.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
